Well, someone in the legal arena actually buzzed me about a recent Intellectual Property Violation petitioned to the local sessions court here in the country. What is being deemed is that it was a case of Advertlets and Nuffnang ganging up against the newest player to the market Cara Com My Media aka GoKita which had traded recently with the brand name of NUFF LETS.
Basically, issues that pertain this legal lawsuit is that the NAME NUFFNANG is not technically correct and due to the incorporation of the Malaysian Principal Entity, that ROJAK ENGLISH aka MINGLISH or SINGLISH is prohibited in the Federated States of Malaysia.
Deem right that Nuff Nang is derived form of Poor Coxney English of East London Afro Caribbean Community of Port of Spain and Jamaica slango which literally means Enough Said (Nuff), Damn, it’s good (Nang)! And the basis of that, is someone Nabil of GoKita tried to mix and match of the two competitor’s platform system of Advertorials and Banners (similar to IZEAS and Adbrite combined) …coined the term NUFFLET.
I know this can be complicated and such and I honestly would not even try to push this to the laws of Malaysia as Nufflet in itself is a British Entity. I know I’m threading on hot coal by talking about this, but as a business perspective, it’s always great to make alliances than to make enemies, after all, a simple lawsuit could even break the biggest of companies like the recent Apple Inc vs Creative Technologies Singapore Limited(CREAF.SG) in the case of iPods and it’s Operating System. Apple itself knew they did wrong and similar to Creative , which copied the methodology of Apple. Right now, both are gunned down and work hand in hand as the base of platforms are similar of Microsoft whom borrowed an OS to sell to IBM (which is actually just of PC DOS aka of Norton!)
My advise is, whatever you do, patent it. And just likewise, THERE IS NOT SUCH COMPANY in SINGAPORE as NUFFNANG, just NETCENTRIC Pte Ltd as there is a NUFFNANG registered in 1996 (Reg No199603142C) , As to the New Nuffnang which is NETCCENTRIC PTE LTD (Reg No 200612086W).
In Essence, Nuffnang in itself is violating company trading act as perceiving as someone else as in itself the owners of NUFFNANG brand would be the company originally registered in 1996. Unless it was a basically company name change or they bought it off the shelf, which I think they did….
So, is the news of you guys suing the competition true? I just hope we all get the commissions in time as they sure got so much money to spend on lawyers. Which makes me think …should I sue…for criminal intimidation ….or shall I squeeze Timmy to grant us all free Starbucks…. (So OK, my settlement will be cheap…as long I’m filled up and drunk enough… which is all to it)
And NUFFNANG PTE LTD is actually OVERSTONE INVESTMENTS PTE LTD which as I said …an off the shelf company. Whylah Timmy..can’t you just fork out $300 and register as a branch of the Malaysian Company instead? I had this information sent to me from GOVT BIZFILE Singapore. You want the info?
